If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Snapback Health Technologies LLC ("Snapback Health," "we," "us," or "our"). Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

The AI Recovery Assistant chat feature provides general recovery information only and is not a substitute for professional medical advice. The AI wound and access site assessment features provide educational information only and are not diagnostic tools. Always consult your healthcare provider for medical questions specific to your condition.
In case of a medical emergency — including chest pain, severe shortness of breath, uncontrolled bleeding, signs of stroke, or suicidal thoughts — call 911 or go to your nearest emergency room immediately. Do not use the Service to report or respond to medical emergencies.
The Service is available to patients of all ages who have been invited by a participating healthcare clinic and have entered a valid clinic code during account creation. Minor patients (under 18) may use the Service only with parental or legal guardian consent. For patients under 13, a parent or guardian must create and manage the account. Healthcare providers are responsible for ensuring appropriate parental consent is obtained before inviting minor patients to the platform.

Snapback Health acts as a Business Associate under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") to your healthcare provider. We have entered into a Business Associate Agreement with your healthcare provider that governs our handling of your Protected Health Information ("PHI"). The Snapback Health platform, including its software, design, user interfaces, content, algorithms, trademarks, logos, and all other materials, is the property of Snapback Health Technologies LLC and is protected by United States and international copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, license, or create derivative works from our platform without our prior written consent.
You retain ownership of the health information and content you submit through the Service. By submitting content, you grant Snapback Health a non-exclusive, royalty-free license to use, store, process, and display that content solely for the purpose of providing the Service and as described in our Privacy Policy.
We strive to maintain a reliable Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or events beyond our reasonable control. We are not liable for any consequences of Service unavailability, including missed reminders or delayed notifications. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without prior notice.
This limitation applies regardless of the legal theory on which the claim is based, including but not limited to:
Our total cumulative liability for any claim arising from your use of the Service shall not exceed the greater of one hundred dollars ($100) or the amount you have paid to us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We disclaim all warranties to the maximum extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation. We do not warrant that the Service will meet your specific needs, be error-free, or produce any particular health outcome.
You agree to indemnify, defend, and hold harmless Snapback Health Technologies LLC, its officers, directors, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right; or (e) any false or misleading information you provide through the Service.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, at the request of your healthcare provider, or if we determine that continued access would create a risk to other users, our Service, or our legal interests. You may terminate your account at any time by contacting us at john.oshea@snapbackhealth.com. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitations of liability, indemnification, and dispute resolution) shall remain in effect.
We may update these Terms from time to time. We will notify you of material changes by email to your registered address or through a prominent notice in the patient portal at least thirty days before changes take effect. Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Coconino County, Arizona, and you consent to the personal jurisdiction of such courts.
Any claim must be brought within one (1) year after the cause of action arises, or be permanently barred.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy and any agreements specifically referenced herein, constitute the entire agreement between you and Snapback Health regarding the Service and supersede all prior agreements and understandings.
